A bit in the News..
NY will be one of the states to recognize same sex marriages from other states. Apparently the new Governor made the choice...this does not allow for marriage yet in NY; however, it's a place to begin...thus eliminating the need for wills, adoptions, and health care proxy documents...

Oddly enough I always thought that was covered in the US Constitution under the doctrine of "full faith and credit". Which would mean that all states would recognize each others Marriage Licenses, drivers licenses, etc.

Here in Oregon we recently passed Domestic Partnership legislation. If I had to agree with the religious fanatical right about anything they're probably correct when they say "This will lead to gay marriage next!!" I don't see how it can't eventually for just the reason you mention . . . . . you can't have licenses that affect couple's rights in literally thousands of legal ways being in effect and then null and void based on crossing a state line. It will have to be recognized on a federal level and by all states to have any lasting meaning.

As I understand it, part of the requirements for statehood would be to grant "full faith and credit" to all the other states in the union, The only exception to this maybe Texas as there admission was unusual. Thus if say someone in California was issued a California marriage license, Alabama would be required by law to recognise it, as long as the state of California recognized the license. However states not abiding by this principle is not an unheard of occurrence, oddly enough CA, OR, and NY are prime examples of states the regularly violate the doctrine.

Each state can recognize anything they wish without Federal regs since each is bound by it's one charter per state. The few exceptions are the "Commonwealth states--4 PA, KY, MA, VA".
Granting full marriage rights by the feds will have to take all states saying yes v. no and the Supreme's will still overturn this right until dooms day. The state which chooses to do so, say okay, may be subject to restricted federal Funding. Heck, NY is Democratic...big lobby power pro gay marriage. It's a move in the direction of equitable treatment for all; I put a post up about this before and was surprised to see tonight the current Governor approved it. He will get his way for other reasons--his backers in NYC & in Albany and the fall of the previous Gov. Spitzer. His political alliances are strong although he admitted to wrong doing before he began post Spitzner...but recall who E. Spitzner took down years ago as AG...they came back to haunt him and back the current Gov. Would not surprise me in the least if prior to Patterson going out of office NY recognizes & allows gay marriages. The major political players behind the state are Bruno, Silver, Bloomberg.
