Who do I choose?

One guy - (ex-boyfriend) lives up north and flies down to see me....cool guy...I enjoy him and he would be one I could settle down with

2nd guy - (friend) Well I started dating a good friend of mine (about 4-5 month friendship) and I have fallen HARD CORE. I have found things in him that make me so happy that if I dont have I dont think i could live without. I am falling so deeply in love with him!

FACT: I pick the 2nd one for the one I want to be with

PROBLEM: The 'friend' might go to jail for reasons that are not true (but there is nothing we can do about life sometimes) and it would be for a long time.

Ive been trying to wait it out to see if he goes.... but my ex boyfriend wants to see me and I keep putting him off

PLEASE RESPOND! PLEASE! IM WATCHING THE POST....I NEED SOME OPINIONS.
