All I'm going to say is everyones situation is different, and what may work for one family, may not work for another. If you know you can trust your kids, then let them text. If you are not positive that they will use their technology responsibly, then limit it or take it away.
As far as the law, I think that if the kid is around the same age as the child he has the picture of, then maybe just some hours of community service with nothing bad on their record would be more appropriate. A minor would probally not totally grasp the concept of right and wrong here.
